All European truck manufacturers illegally agreed their prices with each other between 1998 and 2011. This led to truck buyers paying up to 10,000 euros too much per truck. The cartel was uncovered in 2011 when the MAN Executive Board made a voluntary disclosure.
Which vehicles are affected?
In principle, all trucks with a gross vehicle weight of 6 tonnes or more that were purchased / leased / rented as new vehicles in the EU between 1998 and 2011 are affected. However, because prices do not decline immediately when a cartel comes to an end and this process takes several years, experts have identified significant cartel damages until 2014. In principle, the following criteria must be met in order to receive compensation:- New vehicles
- Permissible total weight: >= 6 tonnes
- Purchase, leasing, hire
- Purchase within the EU + Switzerland
- New price >= 30,000 €
- Even if the truck is no longer in your possession
EU Commission imposes record fine
On 16 July 2016, after a 5-year investigation, the EU Commission imposed a record fine of 2.9 billion euros on truck manufacturers. With the exception of Scania, the manufacturers accepted this fine. Scania sued and lost in all instances. In its judgement of 01 February 2024, the European Court of Justice dismissed Scania’s action against the EU Commission’s fine with final effect.
